A Lasting Power of Attorney (LPA) is a document you complete which gives somebody, (known as the Deputy) of your choice the power to deal with your financial affairs and/or your medical decisions, if for any physical or mental reason you were unable to.
A Lasting Power of Attorney is the only document which gives this power after mental incapacity such as a stroke, provided it is registered with the Public Guardianship Office.
You can not complete an LPA retrospectively
Applying to the Court of Protection is the only option open to an individual, if no Lasting Power of Attorney document is in place
A representative of the Court could be appointed and charges are incurred.
Advance Medical Directive (Living Will)
- Everyone has the right to choose whether they should receive medical treatment.
A Living Will can assist your family in deciding what action to take in the event of your terminal illness and are now recognised by law.
If you wish to leave a request that you would prefer not to be kept alive if all hope of your survival is gone and that you would wish pain relief even if it accelerates your demise. Although this is only a request, most doctors will take notice of the directive.
